Dear Sir/Madam

Registered Persons Taking Over Other Registrant Work

Recently, the Board has noted that in a number of occasions registered person have been engaged by the client to take over professional work that was originally undertaken by another registered person. This circular sets down the framework and procedures to be complied in such situations.

  • The registered person shall obtain instructions from his client and preferably this should be in writing.
  • The registered person or his client shall obtain the consent of the other registered person and preferably this ought to be in writing too.
  • The registered person ought not to represent himself as superior or one who will perform his job better than the other registered person in order to gain instructions. Instructions ought not to be obtained by representing oneself as better then the other person.
  • Fees or costs owing to the earlier registered person ought to be directed to him and the client must be advised to do so.
  • All actions and activities undertaken by the earlier person ought to be adequately compensated. The new registered person must advise his client what the client ought to do.
  • The registered person ought to exercise caution when there is a dispute over fees or other professional matters involving the client and the earlier registered person before taking on the instructions especially if by so doing it will compromise the position of the earlier registered person.
  • The registered person must endeavour to serve his client to the best interest of his client according to the standards of practice and professionalism expected of him.

It is hoped that with the issuance of this circular it will clarify and lay the ground when such takeover of work is required. The circular is issued in the best interests of both registered persons to ensure there are no unnecessary confusion created because of the change.
